North Carolina NCG01 Construction General Permit Renewal Extended - Reissued with No Changes
The North Carolina Department of Environmental Quality (NC DEQ) has extended the renewal date for the NCG01 permit until March 1 – and reissued the current NCG01 permit with no changes until the new permit goes into effect.
Since the US Environmental Protection Agency will no longer allow the NC DEQ to extend automatic federal permit coverage to projects that are approved by a state or local authority, NC DEQ is replacing the current North Carolina NCG01 Permit with two updated general permits:
NCG01 permit for activities that are subject to both the federal Clean Water Act and the NC Sediment and Pollution Control Act (view the draft here)
NCG25 permit for activities that are only subject to the Clean Water Act (view the draft here)
Originally planned to take effect January 1, 2019, the renewal of the NCG01 is now expected to take effect March 1, 2019, and the release of the NCG25 permit will follow on August 1, 2019.
You can follow the progress of both of these permits on the NC DEQ Construction Stormwater website, and review the Fact Sheet of the most recent changes to the Draft NCG01 permit. Some significant changes to the NCG01 and NCG25 permits include:
All spills within 100 feet of surface water must be reported
Rain event inspections are now triggered by 1 inch of rain instead of the previous 0.5 inch threshold
Rain event inspections can now also qualify as a weekly inspection
